Terms of Service
Governing the use of Cascade Forge services. Please read carefully before submitting a project.
1. Services
Cascade Forge ("Cascade Forge," "we," "us," or "our") provides professional 3D printing, design, and related digital fabrication services. Use of this website and submission of a project constitutes acceptance of these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.
2. Orders and Acceptance
Submission of a quote request does not constitute an order or create any obligation on either party. An order is accepted only when Cascade Forge provides a written quote and the client approves it in writing. Nothing is produced until order confirmation is received. Cascade Forge reserves the right to decline any order at its sole discretion without obligation to provide a reason.
3. Pricing and Payment
All pricing is confirmed in the approved quote. Published rate cards are subject to change without notice; the confirmed quote price governs. Minimum order is $30 per build run.
- Orders under $100: payment in full required before production begins.
- Orders $100 or more: 50% non-refundable deposit required to begin production; balance due before shipment.
- Net-30 invoicing available for approved B2B and contract accounts. Terms apply.
Cascade Forge accepts payment via methods specified at time of quoting. Failure to pay outstanding balances may result in suspension of services and, where applicable, retention of completed work until payment is received.
4. Cancellation and Refunds
Orders may be cancelled within 2 hours of confirmation without penalty. After 2 hours, if production has not yet begun, any deposit paid may be applied as credit toward a future order at Cascade Forge's discretion. Once production has begun, deposits are non-refundable. If a completed order is defective due to an error by Cascade Forge, we will reprint the affected parts at no charge or issue a credit, at our election. We do not issue refunds for dimensional variance within standard FDM tolerances, surface finish results within stated parameters, or customer-supplied file errors.
5. Shipping and Risk of Loss
Cascade Forge ships via USPS and other carriers. Shipping cost is included in the approved quote. Risk of loss transfers to the client upon handoff to the carrier. Cascade Forge is not responsible for carrier delays, damage in transit, or lost packages after handoff. Clients with concerns about transit risk should note this when requesting a quote so we can discuss insurance options.
6. Client Design Files and Intellectual Property
By submitting a file, you represent and warrant that you own the design or have all rights necessary to have it produced. Cascade Forge will not reproduce copyrighted, trademarked, or otherwise protected designs without appropriate authorization. Cascade Forge is not responsible for IP violations arising from client-supplied designs. The client retains ownership of design files they supply. For designs created by Cascade Forge, ownership transfers to the client upon payment in full; Cascade Forge retains the right to use the work in portfolio and marketing materials unless otherwise agreed in writing.
7. No Engineering Evaluation
Cascade Forge is a fabrication service, not an engineering firm. We do not evaluate, certify, or warrant that any printed part is suitable for its intended use. It is the client's responsibility to verify that materials, tolerances, and design are appropriate for the application. Do not use Cascade Forge output in safety-critical applications without independent engineering evaluation.
8. Restrictions on Critical Applications
Cascade Forge output must not be used in applications where failure could result in death, serious injury, or significant property damage, including but not limited to: structural load-bearing components, medical devices intended for patient use, firearms or firearm components, or aviation/aerospace components, without written acknowledgment from Cascade Forge and independent third-party engineering certification. Cascade Forge reserves the right to refuse production of any part it determines to be inappropriate or unsafe.
9. Material Properties
FDM-printed parts are anisotropic and have mechanical properties that differ from injection-molded parts or raw material specifications. Actual performance varies by print orientation, infill, layer adhesion, and post-processing. Material datasheets are available upon request and reflect bulk material properties, not printed part performance. Cascade Forge makes no warranty regarding printed part mechanical performance.
10. Prohibited Items
Cascade Forge will not produce: items designed to cause harm to persons or animals; functional firearms or firearm components; counterfeits or unauthorized replicas of branded or copyrighted items; items that violate applicable law. Submission of a request for prohibited items will result in order rejection and may be reported to appropriate authorities.
11. File Retention
Client files are retained for 3 years from the date of order completion for reorder purposes. Files are not shared with third parties. Clients may request file deletion at any time by contacting orders@cascade-forge.com.
12. Disclaimer of Warranties
SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." CASCADE FORGE MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT PRINTED PARTS WILL MEET CLIENT SPECIFICATIONS BEYOND WHAT IS STATED IN THE APPROVED QUOTE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CASCADE FORGE'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY THE CLIENT FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM. CASCADE FORGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
14. Indemnification
You agree to indemnify, defend, and hold harmless Cascade Forge and its owners, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) your design files.
15. Inspection and Acceptance
Clients are responsible for inspecting delivered parts promptly upon receipt. Claims for defects, shortages, or damage must be submitted in writing within 5 business days of delivery. After this period, parts are deemed accepted.
16. Dispute Resolution
Any dispute arising from or relating to these Terms or our services that cannot be resolved informally shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration shall take place in King County, Washington. The decision of the arbitrator shall be final and binding. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction.
17. Force Majeure
Cascade Forge is not liable for delays or failures in performance caused by circumstances beyond our reasonable control, including acts of God, supply chain disruption, equipment failure, or government action.
18. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles.
19. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
20. Modifications
Cascade Forge reserves the right to modify these Terms at any time. Continued use of our services after modification constitutes acceptance of the updated Terms. The version in effect at the time of order governs that order.
